Purpose of this privacy notice
This privacy notice tells you how North Lincolnshire Council uses personal data in relation to the Local Plan website and in producing and adopting planning policy and guidance documents.
What do we mean by personal data?
Personal data relates to living persons and is information that can be used to identify an individual such as name, contact details, address or postcode.

The Council holds personal data through the Local Plan website and the process of producing and adopting planning policy and guidance documents. This includes personal data in the form of names and email addresses used to create a log in account by users for the purpose of registering an interest in the Local Plan and submitting consultation responses. Passwords created will not be visible or known to anyone other than the account holder. Other personal information (such as postal addresses), contact details (including telephone numbers), location data (for example site addresses or business postal addresses) and comments relating to planning policy matters are also collected, to support the submission of land bids and consultation responses. This data is held to support the preparation of planning policy and guidance and keep land bidders and respondents informed of progress with such policy and guidance.
North Lincolnshire Council does not capture and store any further personal information about individuals who access this website, except where you voluntarily choose to give us your personal details. The personal data you provide will only be used to provide you with the information that you have requested.
The Council may collect information via paper or online submissions and consultation forms, email, telephone, letters or face to face at planning policy and guidance related meetings and events.
The UK GDPR lawful basis relied upon to process this personal data is a legal requirement as set out under Article 6(1)(c). The legislation we are operating under is the Planning and Compulsory Purchase Act 2004 – Section 17 – Local Authority to consult with the public and stakeholders during the plan preparation.
Our employees have contractual obligations of confidentiality, enforceable through disciplinary procedures and receive appropriate training on confidentiality and other aspects of Information Governance.
We take organisational and technical measures to ensure the information we hold is secure – such as using secure locations, restricting access to authorised personnel, and protecting personal and confidential information held electronically.
For the purposes of the Local Plan website data is retained for the time that the user maintains their log on account. By creating a website log in account, submitting a land bid or consultation response (online or otherwise) you agree to your contact details being held and used to contact you in relation to the preparation of planning policy and guidance, and related documents.
Personal data may be anonymised and kept for a longer period for statistical purposes.
Data may be shared with others, only where this is necessary to comply with legal obligations or as permitted by Data Protection legislation. This includes sharing with; North Lincolnshire Town and Parish Councils preparing a Neighbourhood Plan or Order, the Secretary of State, Planning Inspectorate and Programme Officer involved in the examination of the Local Plan, other Local authorities and partners preparing joint planning documents with North Lincolnshire Council and consultants preparing planning documents on behalf of the Council. Details will only be shared where it is necessary to the preparation of planning policy and guidance, and related documents that may be of interest to you.
The Council retain information for as long as it is needed in line with the Data Retention Schedule, and data will not be retained for longer than is required by law unless there is a business reason to do so. In most cases information will be retained for six years.
Your data protection rights
Under Data Protection law, you have rights including:
- Your right of access – to ask us for copies of your personal information.
- Your right to rectification – to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
- Your right to erasure – to ask us to erase your personal information in certain circumstances.
- Your right to restriction of processing – to ask us to restrict the processing of your information in certain circumstances.
- Your right to object to processing – to object to the processing of your personal data in certain circumstances.
- Your right to data portability – to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
